SwappAccess | GENERAL TERMS 05/21/2018

These terms regulate the contract between Swarco and the User regarding the use of SwappAccess (“the Service”). “User” means both legal and physical persons.

Swarco is entitled to change these terms on condition that the User has been informed of such changes 30 days before the change becomes valid. Changed terms will be notified by email.

1. Affiliation to the Service
   1.1 Affiliation to the Service takes place by the User registering at www.swappaccess.com (“the Website”). Physical persons must be 18 or older to be able to register.

   1.2 The Service may only be used to pay parking charges after a contract has been signed, through the Service, with one or more Parking space providers.

   1.3 When registering, the User must provide his name, email address (which constitutes his username) and mobile telephone number.

   1.4 As well as the above, the User must choose a password consisting of a secure password and store this securely. The User must not give out his login details to another party or handle these in such a way that another party can understand how the information is used.

   1.5 When the User has registered his user details, the User can register one or more motor vehicles plus which ID carrier(s) (such as, but not exclusively, the vehicle’s registration number or a transponder’s serial number) which must be linked to said vehicle(s).

2. The User’s obligations
   2.1 The User is responsible for ensuring that registered details are correct.

   2.2 The User is responsible for ensuring that login details are securely stored and are not disclosed to unauthorised persons.

   2.3 The User is responsible for all instances of parking which take place in vehicles registered through the Service that is provided by the Parking space providers with whom the User has taken out a contract. The User is thus liable for unauthorised use of the Service. If any vehicle and/or ID carrier is lost, the User must immediately log in and block the relevant vehicle and/or ID carrier.

3. Contract period
   The User can log in and close his SwappAccess account, cancel the contract he has taken out or deregister registered vehicles at any time on condition that there are no outstanding debts.

4. Early cessation
   Swarco is entitled to cancel or block a SwappAccess account if the User uses the Service in contravention of this contract and has not taken remedial action within a reasonable time of being asked to do so.

5. Use of the User’s details
   5.1 We need to save and process personal information about you, such as • Your Name • Your Email-address • Your Phone number • Your Registration number(s) • Serial number for ID-carrier connected to your vehicle(s) • Payment details as e.g. creditcard token (for card payment) or account number when invoicing • Your Transactiondata • Payment history • Parking history

   5.2 The purpose of such treatment is to provide the SwappAccess service and enable registration of your vehicles for payment of parking fees, reservation of parking, administration of parking permits and subscriptions etc.

   5.3 We have received your information from • yourself in connection with the registration and use of the service • parking operator when you park any of your connected vehicles in the garage that is connected to the service and where you have an agreement with the parking operator

   5.4 We apply at any time applicable privacy laws to all processing of personal data. The legal basis for processing your personal data is your consent. You may at any time withdraw your consent for processing. A revocation does not affect the legality of the treatment before the consent is revoked. Your data will be saved as long as you choose to be registered for the service and for the time required to handle unfinished transactions. However, transaction data is deleted after 36 months after completion of transaction.

   5.5 The personal data we process about you is shared with companies within the Swarco Group and with the parking operator you choose to sign with. When you sign a parking permit, you may request the right to share your personal information with third parties. This is stated in the agreement you sign with the parking operator.

   5.6 We may also share your personal information with a third party, provided we are required to do so by law. However, we will never transfer your data to a non-EU country.

   5.7 Data Protection Officer for the Swarco Group is First Privacy GmbH (https://www.first-privacy.com/). You are entitled to contact us if you want information about the information we have about you, to request correction, transfer or to request that we limit the processing, to object or request the deletion of your information. This is easiest for you by contacting us according to contact details for each company below. You also reach our Data Protection Officer according to the contact details below. If you have complaints about our processing of your personal data, you are entitled to file a complaint with the Data Inspectorate in Sweden or to the corresponding authorities in each country.

6. Complaints
   A User who wishes to complain about an error in the Service provided must complain to the Parking space provider whom the errors concerns in accordance with the terms that apply to the relevant Parking space provider.

7. Limitation of Swarco’s liability Swarco is not liable for the User’s loss if a technical function does not work, such as, but not exclusively, the payment function, mobile telephone operator or the email service provider.

8. Disputes and applicable law
   Disputes originating from these terms shall be controlled and interpreted in accordance with the laws in the country in which the organisation providing the Service for the User is active.
